Constitution to Govern the International Free Trade Zone: Preamble: We, the representatives of Haiti, the Dominican Republic, and other CARICOM and CAFTA-DR member states, hereby establish this constitution to govern the International Free Trade Zone, with the objective of promoting economic growth, job creation, and regional integration, while ensuring sustainability, social equity, and respect for human rights and the environment.

Article 1: Establishment The International Free Trade Zone is hereby established as a joint initiative between the governments of Haiti and the Dominican Republic, with the support and cooperation of other CARICOM and CAFTA-DR member states, and is governed by this constitution.

Article 2: Objectives The objectives of the International Free Trade Zone are to:

  • Promote economic growth and development in the region
  • Create job opportunities and reduce poverty
  • Encourage investment and innovation
  • Enhance regional integration and cooperation
  • Ensure social equity and respect for human rights
  • Protect the environment and promote sustainability

Article 3: Governance Structure The International Free Trade Zone is governed by a board of directors, composed of representatives from Haiti, the Dominican Republic, and other CARICOM and CAFTA-DR member states, as well as advisory committees representing various stakeholders, including civil society organizations, academic and research institutions, and the private sector. The decision-making process is transparent, accountable, and based on consensus.

Article 4: Regulatory Framework The International Free Trade Zone has a regulatory framework that includes clear and transparent rules and regulations, based on international best practices, to ensure a favorable investment and business environment. The regulatory framework also includes social and environmental standards, and enforcement mechanisms to ensure compliance.

Article 5: Financial and Credit Facilities The International Free Trade Zone has financial and credit facilities, managed by SourceEnergy Bank & Trust, to promote investment in the free trade zone, including microfinance programs for small and medium-sized enterprises. The financial and credit facilities are transparent, accountable, and based on the principles of responsible banking and sustainable finance.

Article 6: Marketing and Promotion The International Free Trade Zone has a marketing and promotion strategy that highlights the strategic location, favorable tax and regulatory environment, and access to regional and global markets of the free trade zone. The marketing and promotion strategy is based on international best practices and takes into consideration the cultural and social context of the region.

Article 7: Social and Environmental Impact Assessments The International Free Trade Zone conducts social and environmental impact assessments, based on international best practices, to ensure that the economic development plan is sustainable and equitable and that it benefits local communities and the environment. The assessments are conducted regularly and are made available to the public.

Article 8: Dispute Resolution The International Free Trade Zone has a dispute resolution mechanism that allows for the peaceful and timely resolution of disputes between parties. The mechanism is based on international best practices and is designed to ensure transparency, fairness, and impartiality.

Article 9: Reporting and Accountability The International Free Trade Zone reports regularly to the board of directors, as well as to the public, on its activities, performance, and impact. The reporting is transparent, accountable, and based on international best practices.

Article 10: Amendments This constitution can be amended by a consensus of the board of directors, and with the approval of the governments of Haiti and the Dominican Republic, as well as other CARICOM and CAFTA-DR member states. Any amendment must be in accordance with the objectives and principles of the International Free Trade Zone, as outlined in this constitution.
